Terms of Use

These terms apply to scotchbrokers.com, The Pour newsletter and text messages, and the ScotchMarket game (together, the “Service”), run by the ScotchBrokers Investment Club (“ScotchBrokers,” “we,” “us”). By using the Service, subscribing, or joining as a member, you agree to these terms. If you don’t agree, please don’t use the Service.

1. Entertainment only. Not financial advice.

Everything in the Service, including The Pour, market data, commentary, rankings, member picks, and anything said in club chats or group texts, is general information shared for fun and discussion. It is not investment, financial, tax, accounting, or legal advice, and it is not a recommendation or offer to buy or sell any security. ScotchBrokers is not a registered broker-dealer or investment adviser, and nobody in the club is acting as your adviser. Investing involves risk, including loss of principal. Past performance, real or hypothetical, does not predict future results. Do your own research and talk to a licensed professional before making real financial decisions.

2. ScotchMarket is a paper-trading game

• Every player gets a hypothetical $100,000. No real money is deposited, invested, won, or paid out, and there is no cost to play.
• Hypothetical results have built-in limits: they ignore fees, taxes, liquidity and timing, and they don’t reflect the risk of real trading.
• Seasons, seat limits, eligible tickers, pricing rules and deadlines are set by the club and can change. The club’s standings are final.
• Any bragging rights, drinks, or small tokens of appreciation are informal and at the club’s discretion.

3. Data and content accuracy

Prices and market data come from third-party providers and may be delayed, incomplete, or wrong. Some content, including parts of The Pour and the AI benchmark players (“David” and “Damien”), is written or assisted by artificial intelligence and can contain mistakes. We try to get things right but make no promise that anything in the Service is accurate, complete, or current. Don’t rely on it for real decisions.

4. Membership

• You must be at least 18 to join or subscribe.
• Membership is by approval and is limited. We can approve, decline, pause, or remove any member or subscriber at our discretion, including for breaking these terms or the club’s Five Tenets.
• You’re responsible for keeping access to your email secure, since that’s how you sign in. Use your own account only and give accurate information.

5. Play fair

You agree not to:

• use bots, scripts, scrapers, or automated sign-ups, or create multiple or fake accounts;
• try to access other people’s accounts or data, bypass security or limits, or interfere with the site, database, or game results;
• post anything unlawful, harassing, hateful, or misleading, or impersonate anyone;
• use the Service to promote investments, pump a stock, or solicit other members.

6. Your content

You keep ownership of what you add, like your trading name, tagline, avatar choice, and picks. You let us display it within the Service and in The Pour for as long as you’re a member. The ScotchBrokers name, logo, site design, and The Pour are ours. Please don’t copy or republish them without asking.

7. No warranties

The Service is provided “as is” and “as available,” without warranties of any kind. We don’t promise it will be uninterrupted, error-free, or secure, and we may change or shut down any part of it at any time.

8. Limitation of liability

To the fullest extent the law allows, ScotchBrokers and its organizers and members are not liable for any losses or damages arising from your use of the Service or reliance on anything in it, including any real-world trading or investment losses. Since the Service is free, our total liability to you for any claim is limited to $0, or the smallest amount the law permits.

9. Indemnity

If your misuse of the Service or breach of these terms leads to a claim against us, you agree to cover the resulting costs, including reasonable legal fees.

10. Changes and ending

We may update these terms. When we do, we’ll change the date above, and members may be asked to accept them again before a new season. You can leave anytime by unsubscribing or asking to be removed.

11. Governing law

These terms are governed by the laws of the State of Florida. Any dispute will be handled in the state or federal courts serving Okaloosa County, Florida.

Privacy Policy

What we collect

• Subscribers: your email address, and your name or mobile number if you choose to give them.
• Members: your email, trading name, optional tagline and avatar, mobile number, your picks and results, and the dates you accepted these terms, the Five Tenets, and club communications.
• Technical basics: a sign-in session stored in your browser so you stay logged in, plus standard server logs (like IP address and browser type) kept by our hosting providers for security.

How we use it

• To send The Pour and club updates by email or text, and to email members the weekly Google Meet invite and meeting notes.
• To run ScotchMarket: showing your card, picks, and standings to other visitors.
• To approve members, keep the site secure, and stop spam and bots.

Your trading name, tagline, avatar, picks, and results are public on the site. Your email and phone number are not: only the club organizer can see them.

Who we share it with

We never sell or rent your information. We share it only with the services that run the club for us, and only as needed: our database and sign-in provider (Supabase), our form provider (Formspree), Google (for Calendar and Meet invites, which show guests’ email addresses to other invitees), our web host, and our email provider. We may also disclose information if the law requires it.

Texts and emails

Members agree to receive the club group text and weekly meeting emails when they join, and Pour subscribers get the newsletter only. Club texts are sent by hand to people who gave us their number. Meeting notes are shared with members only; what’s said in the meeting stays in the club unless everyone agrees otherwise. Message and data rates may apply. To stop texts, reply STOP or just tell us. Every email is easy to opt out of, too.

Keeping and deleting your info

We keep your information while you’re a subscriber or member. To see, fix, or delete it, send a note through the subscribe form on the home page and we’ll take care of it. Game history may stay in the season’s standings unless you ask us to remove it.

Security

Contact details are locked down so only the organizer can read them, and every table is protected by access rules. No system is perfectly secure, though, so please don’t send us anything sensitive like account numbers or passwords.

Kids

The Service is for adults 18 and over. We don’t knowingly collect information from anyone younger.

Changes

If we change this policy, we’ll update the date at the top of this page.
